Repeated DUIs Can Be Tried As Felonies

The penalties for a first DUI and a second DUI are similar. Both first and second DUIs are Class 1 misdemeanors, and carry the same fine and a potential jail time of one year. The only distinction is the loss of license for at least one year for a second DUI.

However, a third and subsequent DUI is a Class 6 felony. The potential fines are doubled – up to $4000 – and a loss of license for a year. Additionally, the DUI will stay on your record for at least 10 years.
